Legal guarantee of conformity

The consumer has two years from delivery of the goods to obtain enforcement of the legal guarantee of conformity where a lack of conformity appears. During that period, the consumer is required to establish only the existence of the lack of conformity, and not the date on which it appeared.

The legal guarantee of conformity carries the obligation to supply all updates necessary to maintain the conformity of the goods.

It gives the right to repair or replacement of the goods within thirty days of the request, free of charge and without major inconvenience to the consumer.

If the goods are repaired under this guarantee, the consumer benefits from a six-month extension of the original guarantee. If the consumer asks for repair but the seller imposes replacement, the guarantee is renewed for two years from the replacement.

The consumer may obtain a price reduction while keeping the goods, or terminate the contract and be refunded in full against return of the goods, where repair and replacement are impossible, cannot be carried out within one month of the complaint, or cause major inconvenience. Termination is not available, however, where the lack of conformity is minor.

These rights arise from Articles L217-1 to L217-32 of the French Consumer Code.

Guarantee against hidden defects

Independently of the guarantee of conformity, you benefit from the legal guarantee against hidden defects provided for in Articles 1641 to 1649 of the French Civil Code, for two years from the discovery of the defect.

It covers hidden defects that render the product unfit for its intended use, or that so impair that use that you would not have acquired it. It allows you to obtain a refund of the price against return of the product, or a reduction in the price if you keep it.

It is for the buyer to establish the existence of the defect.

Manufacturer’s commercial warranty

The products sold may benefit from a commercial warranty offered by their manufacturer. That warranty is added to the legal guarantees and never replaces them. As an Apple Authorized Reseller, we sell products from the official channel: their eligibility for that warranty is beyond discussion.

The legal guarantees are owed to you by us, in our capacity as seller, whatever the terms of the commercial warranty and wherever you choose to invoke it.

Making a guarantee claim

Write to us at contact@mbs-prime.com, stating your order number and the nature of the defect, or come to the store during opening hours.

We arrange for the item to be taken in hand, transport included, at our expense. No charge is made to you under a legal guarantee.
