Terms and conditions of sale

1. Purpose and scope

These terms govern sales concluded at a distance by MBS, Société par actions simplifiée (simplified joint-stock company under French law), whose place of business is at 122 rue de Vesle, 51100 Reims, France, registered under SIRET number 94511842000013 and 945 118 420 RCS Reims.

They apply to any order placed on the site by a consumer, to the exclusion of all other terms. Placing an order constitutes full and unreserved acceptance of these terms.

2. Products

The products offered are new and sealed. Their essential characteristics are set out on each product page, on the basis of the official information communicated by the manufacturer.

Offers are valid while stocks last or, for pre-orders, within the quantities allocated.

3. Prices

Prices are stated in euros, inclusive of all taxes. Delivery is free in France and the European Union.

The applicable price is the one displayed at the time the order is confirmed. The total amount due is summarised for you before any payment.

4. Orders

Orders are placed without creating an account. Before confirmation, you are given a detailed summary allowing you to check and correct what you have entered.

Confirmation of payment forms the contract. An order number is allocated to you; it allows the order to be followed.

We reserve the right to refuse an order that is abnormal or manifestly fraudulent. Any sums paid are then refunded in full.

5. Payment

A product in stock is paid for in full at the time of the order. No deposit, no partial payment and no instalment plan is possible on a product in stock.

A pre-order gives rise to the payment of a deposit of 50 % of the total amount. That sum is a deposit on account (acompte), and not earnest money (arrhes): it binds both parties and is set against the price.

The balance is taken from the registered means of payment when the product actually becomes available and before dispatch. You are informed by email before the payment is taken. No product is dispatched until the full price has been paid.

Payment is handled by an authorised provider. No banking data passes through our servers.

6. Delivery and collection

Products in stock are dispatched on a priority service and delivered within 24 to 72 working hours after payment is confirmed, in mainland France and in the countries of the European Union.

For a pre-order, the official release date of the product is stated on the product page before any payment. Dispatch takes place as soon as the product actually becomes available and the balance is paid; the delivery time then runs from dispatch. This timetable may lead to delivery more than thirty days after the order, which you expressly accept by pre-ordering.

Items held in store may be collected at 122 rue de Vesle, 51100 Reims, France, Monday to Saturday from 10 a.m. to 9 p.m. and Sunday from 11 a.m. to 9 p.m., on production of proof of identity and the order number.

In accordance with Article L216-4 of the French Consumer Code, we remain responsible for the proper performance of the delivery until the product is handed over to you. The risk of loss or damage passes to you on that handover.

7. Late delivery

Where the date or period announced is exceeded, you may instruct us in writing to deliver within a reasonable further period and then, failing performance, cancel the order in the same form.

Once the contract is cancelled, all sums paid are refunded to you no later than fourteen days after the notice, in accordance with Article L216-3 of the French Consumer Code.

Where the delivery date is an essential condition brought to our attention before the order, cancellation may take effect immediately.

8. Right of withdrawal

You have 14 days from receipt of the product, or from its collection in store, in which to exercise your right of withdrawal without reason or penalty.

Return costs are at our expense. The refund is made no later than fourteen days after we are informed of your decision, subject to recovery of the product or evidence of its dispatch.

9. Guarantees

All products benefit from the legal guarantee of conformity, under Articles L217-1 to L217-32 of the French Consumer Code, for two years from delivery, as well as from the guarantee against hidden defects under Articles 1641 to 1649 of the French Civil Code.

10. Personal data

The processing carried out in connection with an order is described in our privacy policy, which sets out the purposes, the legal bases, the recipients, the retention periods and how to exercise your rights.

11. Complaints and disputes

Any complaint may be sent to us at contact@mbs-prime.com or at 122 rue de Vesle, 51100 Reims, France. We undertake to reply and to seek an amicable solution.

These terms are governed by French law. The mandatory provisions of the consumer’s country of residence within the European Union continue to apply where they are more favourable to the consumer.

Failing an amicable solution, the dispute may be brought before the competent court.
